Pretrial Intervention

Can a person be fired for participating in a Pretrial Intervention program? He works for the Department of Corrections in SC and was not found guilty of the charge. Once the program is completed it will be as though he was never charged. His ex-girlfriend filed a false report claiming he assaulted her and he was charged with CDV. If he is fired, can he sue?

An arrest can have an effect on your employment with the DOC whether or not you are found guilty of the charge. I doubt seriously that he would have a case against them for firing him. His best chance is to be honest with them, that the charge was false, that he's doing PTI, and ask for a less serious sanction at work. He can also grieve the discharge.
