Legal Question in Personal Injury in South Carolina

Charged with Malicious Injury to Personal Property

My son and his girl-friend were in an argument and he kicked her car - denting the trunk. A friend called the Police department and changes were filed for malicious injury to personal property. When he appeared in court she acknowledged to the Judge that damages were resolved - car was not repaired. My son offered to meet her at a repair shop get an estimate and have the car repaired but she refused. Later we received calls/letters from her father asking for an unreasonable amount of money for repairs that he did not cause. Her father is now taking him to court for replacing trunk, repainting car, rental expense, court costs, etc. What are his legal rights and how should he defend himself. Thanks for your assistance.

You didn't say, but I assume that her father is suing your son for the car damages. At a civil trial for damages the father will have to prove the damage and what the cost of the damage is. The best way of defending it is to have a lawyer represent your son. You are welcome to call and I will answer any questions you have.
