It really helps to know more about what happend, like who was at fault. Assuming that the person that hit you was at fault, a claim can be file with thier insurance company. Often that will not work however, because insurance companies do not like to pay out money. In that case, a lawsuit would need to be filed. If in fact it can be proven that they were the cause of the accident, then the injured person would be allowed to sue for more than just pain and being disabled.
