medical expenses more than insurance co wants to pay me

i was a pedestrian in a crosswalk, hit by a speeding 350 Ford truck 2 yrs ago and have undergone extensive PT and medical procedures and have documented injuries that exacerbated existing problems and created new ones, and need surgery for torn ligament in arm. will have to have spinal epidurals for life, as well as pain meds. medical expenses total $50K but insurance co only wants to pay me $40K because i was already disabled and so 'my life is worthless''. no one disputes that the owner of truck is at fault. he is extremely wealthy. i am in constant pain and have all documentation in my favor. what would be a reasonable amt to expect to settle for, considering my docs say i am now 15% MORE disabled than before injury. btw, ALL medical documentation (including MRIs) support my claim. I even tried suicide 4 mos after the accident b/c i was in so much extreme pain, then i found out about epidurals, which i now have every month or so, and botox shots for migraines, as well as cortison injections in arm. thank you very much.

First of all, I'm sorry for all you've been through. You ask an intelligent question, but one that cannot be adequately answered here. Many factors are considered in assessing the value of a case, and I would need more information. Some of the considerations are, the cost of your medical treatment including future, the amount of future treatment and what type, scarring & disfigurement, pain and suffering which could in your case be very extensive, and the list goes on. I agree that the damages are too low. I sounds as if you could collect more than the $50000. You are not getting respect because you have no attorney. Remember that the statute of limitations is 3 yrs.
