Legal Question in Traffic Law in South Carolina

Misspelled name on the ticket.

While in South Carolina I received a speeding ticket with my last name misspelled. Is this ticket still valid ? If not will the violation automatically be dismissed or will I need a lawyer for my court date ?

Anytime you have a legal problem you should consult with a lawyer, as with a medical problem you should consult with a doctor. The misspelling of your name won't make any difference, especially since they have your drivers licence number. It will still go on your record and they will not dismiss it because it was misspelled. If you bring it to their attention, they will simply correct the spelling on the ticket. In most cases, the court or the police officer will help you with either the fine or the points, or both, when you get to court. The only time that they are reluctant to give help, is when the driver either almost hurt someone or was really rude to the officer. A lot of times a person can go to court themselves without a lawyer and get help. However, the wisest thing to do is to have a lawyer do it. The reason is that a lawyer always presents the possibility of a trial, which the police to not prefer.You need to understand that due to the difference in points from state to state, that a speeding ticket in South Carolina with a drivers license in another state, could result in a suspension of the drivers license, depending on the home state and the number of points the ticket carries.
