Moving and change of custody

My husband, who has not paid child support in over three years, is taking his ex-wife to court because she wants to move to be with her husband. He is trying to get custody of his children (9 & 7 years old). He has a job that would not allow him to be with them on a daily basis and would not set aside his activities to put them first. If all this came out would he get custody of his children or would she still be allowed to move?
