Mother Being Sued over Car Accident
My 80 year old mother was involved in a car accident in VA (she lives in TN) October 2005. Her ins. company settled with the man she rear-ended and we never heard a word. This week, (August 2006) she got three phone calls from a law firm in VA. They didn't tell her why they were calling and just ask her her name and then started asking for all of her familys insurance policys and all of her assets and other personal info over the phone. Thankfully, she didn't tell them anything and hung up. We thought it was some sort of scam because she's older. They even left a message on her machine saying if she didn't call them they would get a summons! She got scared. When we found this out this week, and we listened to one of the messages they left on her voice box, we called the number and they said it was involving the accident that happened last year and they had already starting looking up her property, etc. and they were going to sue. Can they do that? Should we call her insurance or a lawyer? She hasn't even been notified that she's being sued officially and supposedly they are sending a letter. The guy said they probably didn't handle it right calling her and asking that stuff but bottom line, that man she hit was suing her.

Call her insurance company and let them handle it. That is why you have insurance. Tell her not to worry.
