Legal Question in Real Estate Law in Tennessee

real estate property ownership

My two sisters and I each have one third interest in eight acres of property. In the event of the death of one sister, will the other two hold joint ownership of the property or will the one third share of the deceased sister pass to her children.

Re: real estate property ownership

If the property is in Tennessee, your sister's share will go as her will directs. If she has no will, it will go to her heirs (children, then grandchildren, if none, her parents then grandparents, if none, brothers and sisters etc....).

This assumes the property is now held as tenants in common.

If the property is held as joint tenants with the right of survivorship, then it would go to the other joint owners.
