Legal Question in Real Estate Law in Tennessee

We purchased property in Ocoee TN in November 2008. The by laws clearly state the minimum sq. ft. for homes is 1200 sq. ft. A new ad (4/09) is offering a home with 1035 sq. ft. Do we have recourse to get our money back or have them cease that offer?
