Disability Insurance

I have disability car Insuarnce and have become disabled and am receiving disability benefits,through meidcare. I have filed a claim with the disability carrier. Even though I am 100 % disabled under Medicare guidelines, I may work and make up to 760.00 per month and still qualfy for Medicare. Car insuarnce disability company states they do not follow medicare guidelines. So they will not pay because I am working. I expected them to pay pro ratio amounts, but not to totally disallow the claim. Is this discrimination. The physicians felt it would be good for me to work this limited time for my well being since I am so young. Also it allows me to keep Insurance, since I will not receive Medicare insurance for two years.

It does not sound like disability discrimination. If the insurance company is unfairly refusing to keep their end of the bargain, remedies may be found in Bad Faith action against the insured. Suggestion: obtain and read the insurance company's administrative process for appealing a claim denial.
