Legal Question in Credit and Debt Law in Texas

Family responsible for debt of dead family member?

Would the family be responsible for paying the monetary debt of a dead family member (unpaid taxes, credit card debts)? If a living family member is building a mountain of debt, can the rest of the family get a divorce from them so as not to be responsible for the debt?

Re: Family responsible for debt of dead family member?

The answer to the first question is no, unless the family member is responsible contractually on the debt. Just being a family member does not make you liable for the debts. You had to have agreed to be responsible for the debts - be on the contract for the debt. Same goes for second question, you are not responsible for someone else's debt unless you have agreed to be so.
