Legal Question in Credit and Debt Law in Texas

Being sued by credit card

I recieved a Citation for Personal Service saying I'm being sued by my credit card co. I've heard nothing from them in almost a year other than an Aug 'your statement is available onine'& notice that late payment was reported to credit bureaus. I couldn't afford to make payments after they put the rate so high after a late payment when I couldn't get online access, couldn't get them by phone. (this was their paperless save everyone money feature) Someone called and spoke to my husband but wanted me (I wasn't home). Nothing till now. In the petition it states that monthly statements with all credits, purchases, late fees ect... were mailed monthly, this is not so. Now it says I have twenty days on the Monday next after being served to file a written response. I don't know how or what to do. I don't understand this. They have made no attempt to contact me until now. What is 50 day discovery? With what and how am I supposed to respond?

Re: Being sued by credit card

You can write to the court denying the accuracy of their claim, or you can speak with a lawyer to help you respond. Or you can contact the plaintiff's attorney, explain the situation, and see what arrangements can be made to compromise and settle the debt.
