Legal Question in Criminal Law in Texas

clearing your record

5 years ago I was arrested for forgery of commercial instrument. However, I was not the one to write this check and had no idea of the occurance until the actual arrest. I was dooped into writing a confession, I was unaware of the trouble I was in and the officers were just asking several questions that I thought if I cooperated would be ok (Now I understand the concept of having the right to remain silent). The funny thing is that one of the persons aware of the whole situation was never prosecuted and the other seems to be having a normal life. (he was even able to leave the country while on probation) I had no criminal history prior to this incident, and was told by the D.A. that if I were to follow through with deferred adjudication my record would be wiped out. this whole case has been a nightmare for me I would love to join a government agency however I now know that with this case still on my record it will never happen. I do not believe I was represented fairly! I was recently informed that I can retry my case or look at the possiblities of getting it expunged. What would be the best case scenario for me to persue to completely get this case off my record.

Re: clearing your record

A few years ago a case came out that basically said that if one could prove they were actually innocent this new evidence could override a guilty plea.

This is the only way your case is probably going to be reopened.

If I could be of any help feel free to contact me.

Sincerely,

Erick Platten
