Legal Question in Criminal Law in Texas

Federal case

My son is in the Federal Medical Center in Ft. Worth, Texas serving 10 years for drug charges. He has an understanding with his friends that if one goes to the ''hole'' the others get his stuff from his room and keep it for him so it won't be taken. My son was doing that for a friend and was put in the ''hole'' because unknown to him his friend had some drugs. He has been in the ''hole'' for about 5 months while the FBI is deciding whether or not to charge him with conspiracy. He was not found with any drugs on him and has never failed a UA. Does he just need to wait until the FBI decides what they are going to do?

Federal Drug conspiracy cases have a punishment range of 10 years to life.
