Legal Question in Criminal Law in Texas

misdemeanor charge

I have a misdemeanor charge for theft by check20. I have not been convicted, but I put the checks on payment plan which automatically entered a guilty plea. I was informed by a court appointed lawyer that once that payment plan was completed the chages would be dismissed. I want to know if this will still show on my background.

Re: misdemeanor charge

If you were arrested, then a record exists for sure. Even though the charges are dismissed, the arrest record still remains. If you entered a plea of guilty, then presumably charges were filed with the local court. If so, then a record exists there, as well. Assuming these facts are accurate, your arrest and court case would probably show on a criminal background check. However, you might be eligible for an expunction or nondisclosure order. Check with a qualified criminal defense lawyer to discuss these possibilities.
