Legal Question in Criminal Law in Texas

where to i seek help?

My husband has been remanded to Seagoville correctional institute based on presentation to the federal government from a county other than in which we reside. Since this has happened I have reson to believe that the search warrant was not signed by a magistrate prior to the execution of such warrant. As it shows to be signed 3 minutes prior to entry. Based upon a statement from the magistrate that he gives no issuance from the field, we live 22 miles from his office. I have tried to contact the local internal affairs to be told that they no longer have any involvement into this case. And our attorney refused to prceed on these grounds as it means criminal charge against the local law enforcement. So my husband stands to do 30 years because no one wants to buck the locals? Where do I go for help.

Hi there,

I understand your frustration and this should have been brought up in a pretrial motion to suppers evidence.

My question to you is. How long ago was he convicted?

If less that 30 days it can be appealed.

If longer he has rights to file a writ.
