Legal Question in Family Law in Texas

Assault w/Bodily Harm--Family Member

My husband & I recently had an

argument that escalated into a lot of

yelling. This is the first time we've

ever had a fight like this. During the

course of the fight, he grabbed my

arm. I grabbed his collar and tore his

shirt, which resulted in two small

scratches. The police arrived and I

was arrested. My husband doesn't

want to press charges and feels this

was just a case of a bad night

between us--a fight gone wrong. But

we WANT to be sure this doesn't

happen again and have already

started taking couples' counseling.

This was my first arrest and no

protective order was signed. My

husband included that he didn't want

charges filed in his statement (we

understand that the state picks it up

at this point), went to the jail and

signed papers that he did not fear

me in anyway and has signed a non-

prosecution affidavit. We want to

move on and try to make a positive

from this event---we know we need

to NEVER let our emotions get out of

control like this. What is the likely-

hood that my sentence will low / the

case can be dismissed? Thank you.

Although all jurisdictions handle these situations differently, if you have a good lawyer, then your chances are pretty good.
