does a father have the same rights as the mother when it comes to child

If the parents are not married, the fathers rights are not established until an order has been entered.

In Texas, the laws are gender neutral but I don't know if that is what you are asking.

I did 4 mediations last week and 3 of them involved fathers asking for custody of their teen-age children. I most cases the custody was switched for the next 6 months to Dad's house to see how the kid likes it and how the child does in school while with Dad primarily. They will come back to me next November for re-evaluation.
