Legal Question in Family Law in Texas

Fathers Day and visitation

I have custody of my 16 year old son, we have standard visitation. Fathers day falls on the third weekend of the month which he is suppose to go to his mothers house(1st,3rd,and 5th). Do I get to keep him that weekend or how does it work? Ive read my paperwork but cant quite understand what everything means. Thanks in advance for any info provided.

Also, there has been times in the recent past that hes visited his mother and she allows him to drive a vehicle, that isnt hers but her grandmothers, around town without him having a driving permit or license! What can I do about this? Can I file child endangerment? This isnt the first time she put him in danger, shes done this over a period of time with CPS stepping in 4 years ago and me winning custody.

Re: Fathers Day and visitation

In almost all Orders/Decrees Father's Day and Mother's Day trump normal visitation. So no matter who's weekend it is Mom get him for Mother's Day and no matter who's weekend it is Dad get him for Father's Day. Without reading you actual Order/Decree there is no way to be sure but it should be in the section titled something like "Holiday Unaffected by Distance".

As for the driving, allowing the child to break the law and endanger himself might be grounds for changing the terms of custody and visitation.

Call the office if you would like to set up a consultation to discuss these matters in more detail.
