Legal Question in Family Law in Texas

Final Divorce Decree/Child Custody

My husband initially filed for divorce and requested custody of our 7 yr old son...we currently have a temporary agreement in place that was established during mediation where our son will remain with him and i am responsible for paying child support and visitation is set. Since then my son's father has agreed to allow my son to come back to live with me permanently, he is in my physical custody at this time. Could we at this point simply revise the final divorce decree that was prepared by my husband and change Petitioner to Respondent where indicated and present that to the judge or is there a different process that must be followed. I appreciate any help in the matter. Thanks.

Re: Final Divorce Decree/Child Custody

Why don't you have an attorney? A divorce involving children is not the place to go it alone, nor is it the place to allow a controlling spouse to do-it-himself. You probably wouldn't feel safe allowing him to remove your gallbladder, so if you wouldn't let him play doctor, why are you letting him play attorney?

To protect yourself, your child, and your interests, you really need to go talk to a good family law attorney. Good luck!
