Geographic Restriction Removal

I agreed to a geographic restriction for myself and my son when a custody agreement was court ordered; however, now, I am planning to marry and my future husband lives out of state. His career returns a much higher income for a family and will allow for me to stay at home with my son now and children we plan to have. How can I have this geographic restriction removed so I can move?

You should be able to file a modification tied to the sapcr. What county are you in?

I agree with Mr. Copeland, and want to add that this is not a minor issue. I strongly recommend that you consult with an attorney and not try this on your own. Different judges have very strong opinions on this subject. In Collin County it is not unusual for a judge to tell a parent to make a choice between custody and the new spouse. If there is a bond between the parent and the children, the judges around here are not likely to let those children leave the county or contiguous counties.
