Legal Question in Family Law in Texas

I have joint conservatorship with my ex-husband. I will be remarrying soon and wish to move to the city in which my soon to be husband lives. However, I know my ex-husband will not agree. What are my rights?

I assume you have a residency restriction. If so, you will need to go to court to try to lift it.

You need to talk to an experienced family law attorney in your area about the judge that will hear your case.

If the residency restriction is not lifted then Dad will get custody and you will visit your children.

If Dad is actively involved in the kid's daily lives, then the court might not lift it.

Mediation might be an excellent option for you. It allows more flexibility than the judge would allow. Perhaps you could offer him more time in the summer, every spring break, and lower his child support to make lifting the residency restriction. Also, offer to pay for skype so he can visit the children over the internet easily.
