Managing conservator arrested/Agg sex assault of a child

Father of seven year old girl made the managing conservator of the child because we could not afford to fight him.Recently CPS removed her from him and placed the child with her mother after the managing conservator was charged/arrested on 3 counts of aggravated sexual assault of a child(on his own daughter),there is also a charge for the kid next door and a chrge of child porn on the internet. He is currently in jail in Harris county. We are told that we need to file for legal custody to prevent him from getting her back.We live in Howard county Texas,the original divorce was filed in Harris county and the child has resided in Harris county.I am looking for a way to move this to Howard county or for an attorney willing to work on a payment plan to file the custody papers in Harris county. My goal is to protect this little girl,she is seven years old,her innocence has been stolen,CPS says because he is the managing conservator he can get her back and continue this abuse if we don't file for custody. I checked with 2 atty's in Howard county, both said we need an attorney in Harris county to file. We don't qualify for legal aid or the pro bono group in Harris county because we are not harris county residents.

Yes, you would need to start in Harris County and transfer the case to your county.
