Legal Question in Family Law in Texas

Managing Conservatorship

I was awarded physical custody of my 9 year old son in 2001, without a geographical restirction(it's stated in the order). His father and I were never married. I have since married and have moved out of the country for the next year. His father has filled for custody. His father has never lived in the same city as his child so he has never been involved in the day-to-day activities of his son. He has never been to a school event or parent/teachers conference. He is an attorney that has only been paying 300-400 dollars a month in child support. He has never obtained the court ordered medical insurance for our child. Does he have a case? He only saw his son maybe once/month and some holidays. We have a lawyer and he is very confident about our case. I was briefly married in 2001 and divorced because of domestic violence and my sons father is claiming that I am a bad mother because of this. I am a college graduated pursuing a Master's in education and my husband is a military officer(Major). My sons father is married and expecting a new child. We set up an arrangement for my son to spend one semester with his father to help thier relationship, now he wants custody. Addtionally, my son's father has requested a jury trial
