Under order to sell h ouse, but wife stalling. How should I proceed to compel he

I have been separated since March of 2003. I filed for divorce in the same month. The initial hearing was in June. The court has ordered me to move into my wife�s house and pay for it until the house is sold, or the divorce is final. In April of 2003, my wife filed an insurance claim for hail damage to the roof. My wife did not reveal this until November of 2003. She has our tax refund check of $2600.00, yet she says we don�t have the money to pay the $1000.00 insurance deductible. I have offered to cash the insurance check, use $1k to pay the deductible, and split the remainder. She has refused. Her attorney says that she will be willing to negotiate, but only after I allow her to take the refrigerator, washer and dryer, and all the furniture from the house. This would make the house unlivable. I am considering filing a motion to compel her to go back to court. I currently have no legal representation, as I have no more money for an attorney. We are under court order to sell the house, but we can�t sell until the roof is repaired. I would like the court to see that she has withheld information and stalled on the home sale process for almost a year. Is this a good strategy?

With a house, you may not be without resources to hire an attorney. If there is equity in the house you can probably find some way to hire a family attorney. My office is in Bedford. [email protected]
