Legal Question in Family Law in Texas

question about custody...

I was told by a police officer that if my child's biological father were to pick up my child from daycare & take physical possession of her & refused to give her back, that I would have to file a court order to get her back. I this true? I am the custodial parent & he has been missing for six years. He decided recently that her wants to see her again. I have been letting him call & have a couple of supervised visits. He recently threatened that he was going to take her & keep her for 2 weeks, I refused, he showed up, police were called... He has paid child support only a handful of times. Waiting for the attorney general to move the court case to the town where I live which is over 300 miles away. I'm really worried about him him showing up at her daycare & taking off with her.

Re: question about custody...

If you are the custodial parent, you have an order from the court. Get a certified copy and give it to the day care. Most day cares require a list of authorized person to pick up the child. Make sure his name is not on the list.
