Legal Question in Family Law in Texas

Sole Custody Parent Seeking to Relocate

I have sole custody of my 6yr old son. We live with my boyfriend whom I have been with for over a year. We are a happy family and plan to remain that way. My boyfriend has been offered a great job in California and we would like to relocate. There is not a provision in the custody agreement regarding moving out fo state. It just says I have the right to establish the legal domicile of our child. My son rarely sees or speaks to his father. His dad does not stay in regular contact with him. He has not paid any child support since we divorced. I do not want to take my son from his dad but we have a great opportunity in California. If we were a traditional nuclear family, we would definately make this move without hesitation. Aside from notifying my ex in writing, is there anything else I need to do? Do I need to go back to court for permission to relocate? Please help.

Re: Sole Custody Parent Seeking to Relocate

Is there some requirement in the order that requires notice to the father? If not, why bother? He would have to file an objection & show that it is in the best interest of the child for you not to move. Since he is not involved in the child's life, not likely. Good Luck.
