Legal Question in Family Law in Texas

My son's mother and I were never married. I want to see him (I am listed as the father on the birth certificate), and she is telling me that I cannot see him. There are no custody or child support orders in place. I am trying to do this on my own as I cannot afford an attorney. Where can I start? Is it legal for her to keep him from me? We both live in Texas.

You could just go grab him, but that would start a pig fight and could lead to your being harassed by law enforcement. It's not illegal for you to do that--just not a great idea.

The best way to proceed is to ask the Attorney General's office to put you on child support. All child support orders come with rights for possession of the child. The attorney general will do this at no cost to you. You might as well do it because she will do it eventually anyway and you will face a painfully gigantic back child support obligation when she does.
