Legal Question in Family Law in Texas

if your spouse takes your child away from you and flys him out/over state lines without your knowledge and hides the whereabouts from me for 5 days and counting, does that constitute kidnapping?

If there is a court order covering the parent child relationship, or child custody in a divorce, it sounds like this action may violate the order. You'd need to review the order or have a lawyer review it.

If you are married to each other, then each parent has equal rights.

Only if there is a court that has signed a final legal document can a parent be "kidnapping" a kid.

If you don't have a good family attorney, you definately need one NOW.
