Legal Question in Family Law in Texas

Last week I asked the question "My fiance hit me and smaked me around (first time he ever layed hands on me) and kicked me out of the house while my son was at his dads. My father called the police and my fiance was arrested while I was moving out. My fiance is now in anger mgt and counseling. My ex is threatening to file a restraining order and then file for custody of my son if i move back in with my fiance when he finishes his anger mgt. Does my ex have a leg to stand on?"

Answer I received: "YES"

My next question is that: Even though my son was not at home when my fiance did this and my fiance has never been anything but kind to my son (he is 9 years old and loves my fiance and would testify that he has never even been yelled at by him), my ex could still take my son away from me if I moved home? My ex is a surgeon with 3 practices and lots of money. I have very little. Should I even get a lawyer (on credit as I have no savings) or will my ex most likely win and it is a pointless fight forme to battle?

You need to sit down with an experienced family law attorney in your area that knows the judges!

You need to get away from your fiance! Sorry!

Move to a shelter & start over. You sound like an abuse (battered) woman! Now you are just willing to give up and roll over! This is very typical abused behavior! You need counseling! You need to rebuild your self-esteem!

You really can start over and become an independent & vibrant woman!

Please get counseling!

You can rebuild your life. You need to do this for you and your son.
