Legal Question in Civil Litigation in Texas

Car Payments

I am making monthly payments to an individual for a car loan. I was two weeks late on one payment. I called him before I was late and told him I would be late (two weeks). I made up the payment on the 4th of Dec, and will continue monthly scheduled payments. He sent a letter stating that he prefers me to pay the entire balance of 6,900.00 because I was late. Our contract does not state that provision. To date, he has not cashed my check. What should I do??? How many days can he hold the check? Does he have the right to take the car if I made arrmangements with him concerning the late payment? What do I need to do if he refuses to accept money from me?? I have moved, should I give him my new address? Also, sometimes he curses me out when I call him. What should I do??

Re: Car Payments

I'd send the payments to him by certified mail, return receipt requested. It costs an extra $4.05 but it makes certain that he either received the payment or he refused to accept the payment. If he refuses it, keep the envelope sealed with the check inside just in case.

You'll have to put a return address on your mail, so he'll know that address.

There's no legal solution for bad manners or boorish behavior. Sorry.
