my ex-husband is in control of how to buy and sell my stocks on this account. I have documentation of his promise to honor the monies he lost for me because he was making some very high risk choices. However I have further learned about how he has used me for my tax deductions these last 4 years as I am a stay at home Mom. Anyway he short changed my portion every year since the tax year filed beginning 2005. All this came about when I learn how much he shorted me this year- because I finally got a copy of the the last 2 year returns. I was shocked to see that he was keeping most of my portion due to me. Anyway cause he had a error in this 2007 return which originally he was trying to get my to pay back to him. Cause he needed me to sign the check for this year was where I learned the real amount of the check,which also showed that he shorted me by 3000.00 Which he finally did give me but told me I would have to pay back if he had to pay back a 5000.00 difference which I learned was from the previous year. On top of all the lies I have recently learned I no longer trust him with anything having to do with handling my money. I want him to give me the ability to give the company that was controlling my IRA before to run it again.

Sure, you can do that. You need a really good family law attorney to sue him for an accounting and reimbursement of your community share portion of the IRA account. Good Luck.
