Legal Question in Civil Litigation in Texas

Liability

My husband drove a very drunk friend home the other night in the friend's car (obviously the friend could not drive), hit a pot hole that did cause damage to the vehicle. My husband has limited vision in his right eye, which the friend knows. What we didn't know is that the friend only carries liability on his car. He wants my husband to pay not only for all damages, but for car rental. Is my husband responsible for paying for all the incurred costs ? We did not know he had limited coverage, we were trying to keep him from driving impaired.

Turn it over to your auto insurance and it will laugh at the "friend"

Tell your so-called friend to take a hike. He's trying to have you and your husband pay for things that insurance typically pays for - that is, when someone's friend isn't too cheap to buy it! You don't owe him a dime.

I agree. Have your car ins. carrier handle this and I wish I could watch your "friend" try to justify himself.
