Legal Question in Employment Law in Texas

question about umemplyment insurance

I'm wondering what I can do it my current situation. I was terminated frem a job about 2 years ago in and I recieved umemplyment insurance which helped me to find a new job. That was fine until about 5 months ago I recieved a letter stating that I was overpayed or was not suppose to have recieved the money because of ''misconduct.'' I've already had two appeals. I would like to know whether there is any way I can stop them trying to make me pay a sum of almost $7000 dollars when they had granted me that money and I used it while looking for work and don't have it to pay back? Thank you.

Re: question about umemplyment insurance

In order to avoid paying TWC for the "overpayment" you need to successfully appeal the TWC finding that you were terminated for "misconduct." Since this finding took place 2 years after the termination, there is a possibility that that the employer did not timely appeal the initial TWC finding in your favor. In that case, you will succeed based on the employer's failure to follow the administrative procedures.
