Questionable Termination

I am writing this for my 37 year old daughter who was recently terminated without cause.The termination letter states that her termination is permanent and without cause.

My dauther believes that she was terminated because of her higher salary and additional benefits she will receave becuase she just completed five years with the company and will receive additional benefits.

During the five years of her service she was a model employee and have received good reviews.

Her position was not eliminated but was offered to a lower paid receptionist with a promotion. The company has plans to replace the receptionist.

My daughter feels that if salary was a problem, and the company is having financial difficulties,they should have talked to her and not terminate her the way it was done.It was the last of work Friday and 45 minutes to the end of the day. She was brought into the supervisors office, he read the letter give it her to read and sign infront of an executive secretary.

In the eyes of her peers it looked like that she has done something tremendously wrong and was immediately terminated. To make matters worse the suprvisor in this case has resigned from the company and was leaving within a week.

Texas is an employment at will state, and someone can be terminated for no reason at all, or even for a wrong reason, and there is usually nothing that can be done legally to contest the termination even if they have been the best employee a company ever had. Unless the termination was because of her gender, or because of another discriminatory motive, she does not have a basis to seek compensation for the termination, or to seek reinstatement. She should, however, be entitled to unemployment benefits.
