Legal Question in Personal Injury in Texas

Hello,

I was in a car accident. I was driving through a parking lot when the other car backed into me. We did not call the police. We did exchange information. Now my insurance is saying that his wife is claming that he was forty miles away at the time. They have not spoke with him. My insurance is saying that I need proof or they will drop the claim and I will have to pay the $500 deductible. I did take photos of both vehicles at the time. Is there anything I can do.

I do not work at the job anymore. I have no way of contacting the guy who backed into me.

You can sue the driver in small claims court. A win there will be conclusive. Otherwise, you can hire an attorney to represent you, but the problem with that is that an attorney may not want to handle this on a contingent fee basis since the amount of recovery is small. If you could prove your insurance company was acting in bad faith, then you could recover enough damages to make it worthwhile for an attorney to do it on a contingent fee basis.
