I was involved in a car accident in Texas, what am I legally entitled to as far as pain and suffering is concerned?

There's no way to know the answer to that, as every case is different. My recent experience has been that the insurance company will assume that you weren't injured and/or that you're malingering. I always recommend against doing these cases without professional help. Most lawyers (myself included) will review your case with you at no charge, so you should at least meet with a few to discuss your case.

There are 13 potential categories of damages in Texas. Obviously, how many of these areas of damages you qualify for, and for how much in each category, is dependent upon many factors. Of course, the insurance company will be doing its level best to assure that you collect zero--or as close to zero as possible. (You must always remember that, in spite of their spiffy commercials, insurance companies are not in the business of paying claims.) Your best bet is to hire an experienced personal injury attorney to fight your battle for you against the insurance company. Have a good attorney on your side puts you on an equal basis with the insurance carrier (who has an entire firm of attorneys working for it) and helps assure that you collect fair compensation for "pain and suffering" and all of the other damages that Texas law entitles you to.
