Legal Question in Social Security Law in Texas

Do I qualify for belated benefits?

I was living with my father, when he carried me back to my mother so he could go into the hospital and die. When my mother applied for benefits, they said that We could not prove that he is my father. I just recently found this out,and have peen persuing it. We can have DNA testing done from my father's sister, and my half brother, who collected benefits. When we told SSA that, they changed their mind and said that it was a matter of time, that we did not file in the allotted time. We have proof that my mother tried to file but was denied. Am I elgiable for benefits?

Re: Do I qualify for belated benefits?

Time limits apply for appeals to a wrong decision by SSA. It is very difficult to pursue benefits after the time limit has expired. If you are still under 18, you may be able to make a new claim and there may be a slight and difficult possibility to obtain past due benefits.
