Legal Question in Wills and Trusts in Texas

death of a parent

My dad died in May and we cannot find a will. Can one of the four children be appointed to handle the estate without going to court or hiring an attorney. Does the person appointed have to live in the same state, county or town that my dad lived in? We are all in agreement that some one needs to be in charge but do not have legal authority to move forward.

To answer your questions:

1. There are a few matters you can handle yourself without an attorney. There are several matters which require an attorney. It depends on the assets and liabilities of the estate.

2. The person appointed does not have to live in Texas. If it is an out of state person, then the person needs to appoint a registered agent.

You should meet with an attorney to discuss the estate and see what your next steps would be. Most attorneys will give an initial consult or phone consult for free.
