Legal Question in Workers Comp in Texas

Settlement from injury

02/14/07 I was crushed by a 2000 lb crate. I have had 3 surgeries since then. One surgery was for a rupturerd testicle which I almost lost. Urologist has noted that my secimen/sperm count is extremely low-3 million where a average male count should be 50 million. Naturally I will probably never be able to have a child and I may need to goto a fertility doctor. Besides my impairment rating for my 2 broken ankles and fused big toe, should my testicle problems be included in the settlement ?

Re: Settlement from injury

All of your injuries should be included in your impairment rating. The DWC uses the AMA Guides to the Evaluation of Permanent Impairment, 4th Edition to determine impairment ratings. This injury is covered in Chapter 11 of that guide, and ranges from 0% to 20% impairment depending on diagnostic test results, anatomical alteration, and future treatment needed.
