Workers Compensation

I was told back in 1991 that I would be covered for my work related injury under the lifetime medical plan of workers compensation. Can they just cancel your lifetime medical under workers compensation at any time and leave someone hanging with no explanation?

A Texas injured worker is entitled to all reasonable and necessary medical treatment that is related to the compensable injury, and that is for life. It cannot be taken away. However, disputes arise sometimes over exactly what treatment is reasonable and necessary.

The DWC has a medical review division that handles disputes over medical treatment and preauthorization issues. Oftentimes, these preauthorzation issues are resolved by filing form LHL009, which asks the DWC to appoint an independent review organization to review the preauthorization request and determine whether or not it must be preauthorized despite the carrier's denial of benefits.

Yes if you do not contact Texas division of workers compensation and let the Office of injured employees counsel help you. Unfortunately Texas does not let work comp claimants pay lawyers to help them get medical treatment under workers compensation law.
