dr double billed me and insurance and got away with it

i saw a dr in utah for emergency treatment while traveling in june 2001, i pd him full (he required this)and agreed to submit to my insurance for reimbursment. he did, but payment was sent to him, not me. it took 1.5 years to clear that up with insurance to find out what happened, partly because he moved his practise to arizona. i wrote him, reviewed the facts and very nicely asked him to send me my reimbursement. He never did. i want my money. how can i get it? small claims court through the state i live in now? mass. or the state where i saw him? utah. or where he is now? arizona.

What a mess! Congratulations, though, on your persistence. Generally, you have to sue someone where they live or work. It doesn't sound like this Dr lives or works in Massachusetts. Although he did his misdeed in Utah, he now lives in Arizona. Based on what you've told me, I think you have to go to Arizona. Sorry! David Baker

You should sue the Doctor in the state where he now resides.
