Legal Question in Family Law in Utah

alimony

If the person who has to pay alimony looses their job, are they still responsible for making those payments and what is likely to happen if they file a petition to modify the decree. The person receiving the alimony is also unemployed.

Re: alimony

It depends on why the person lost their job. If they were fired due to some misconduct, then it's much more difficult to modify the decree. If they lost their job simply because the employer laid them off as a workforce reduction, then the court would, in all likeliehood, modify the decree either terminating, suspending or reducing the alimony until that persone becomes re-employed. Re: alimony

You are still required to make payments ordered by a court even if you lose your job.
