Legal Question in Wills and Trusts in Utah

How can I find out if my dad had an addendum to his will. He lived in Utah, and it did not go into probate. His girlfriend may have gotten rid of it.

If the will was not probated, there is no way to find out if there is an addendum, codicil etc. In Utah, you can deposit a will with the court prior to probate, for storage purposes, but there is no requirement to do so, and most attorneys don't do this because of the inconvenience if a client moves, later makes changes their will, etc. A will does not become a public record until and unless it is probated. You can apply for probate and then all documents available should be filed with the court. The court will then determine how the assets are distributed. If there are missing documents there is little you can do, unless you can get a copy. After filing for probate you can request to be named the personal representative of his estate, and you would then be in charge of his assets, and have power to search through them for additional documents.
