Legal Question in Disability Law in Virginia

My son has ADHD and we don't want to put him on medication. The principal in his school told us that the consecuence for not medicate our son maybe the possibility of not been asked to comeback the following year for being to distractive to himself and his peers. Is this legal?

Yes, quite possibly so, if the child is actually disrupting school classes and

the situation cannot be ameliorated through his taking appropriate medications

because you as his parents will not consent to it.
