Who has the right to use the name?
I was partners without an agreement for 8 years and partner performed a takeover, shuting me out and locking up the store on his property. We were in the beginging stages of a second location when this happened. He asked to be taken off the lease, which I did, and am continuing moving forward to opening. He is telling me I can not use the name. We had filed a DBA in the county 5 years ago with both of our names on it. Who can use the name?

You can (as well as he) until the filing authority decides otherwise.
