Legal Question in Credit and Debt Law in Virginia

I borrowed money from and individual 4 years ago in Indiana. We did not have an Agreement when it was to be paid in full. I have been doing my best to repay. I originally borrowed $4000 and still owe $1150. Now he is threating to take me to court because it is not paid off. We have had financial sets backs including a foreclosure., additionally medical bills and income decrease. It has been difficult to pay him but continue to send what we can. I now live in Virginia. Can he sue me in small claims court like he is threating? Also, we never had a written agreement. He has threatend me 3 times now over the four years.

Yes, he can sue you, and, furthermore, the agreement doesn't have

to be in writing to be legally valid and therefore enforceable.
