Divorce

I left my husband and told him I want a divorce, after I left. I am seeing someone else, and currently am pregnant with the other man's child. I've only been married to my husband about 6 months. Do I have to file separation then divorce? Do I qualify for an anulement? Or can I just get the divorce papers and my husband and I sign them?

Re: Divorce

You have to live separate and apart continuously from your husband without cohabition for at least six months in order to have grounds for a no-fault divorce in the Commonwealth. (There is no legal separation status recognized in Virginia.)

Your husband, however, apparently could immediately initiate divorce proceedings if he wanted to on the grounds of your adultery(no waiting required).
