Legal Question in Family Law in Virginia

Father's Rights as to Where His Daughter Lives

If the mother, who is the custodial parent, decides to take 6 year old Daughter from VA to another state to live, what right does the Father, non-custodial parent, have if he wants the Daughter to remain in VA. Moving would place a hardship on the Father. Mother and daughter have been living with the Father of the child for the past 6 years. He has been supporting them both in his home. Also, the mother has bad health. Does living with the Father of the child nullify her custodial parentage in any way? Appreciate your prompt response.

Re: Father's Rights as to Where His Daughter Lives

The mother's legal status as unshared custodial caretaker of the minor child continues until modified by the court having jurisdiction over the matter.

The father of the child can file a motion with this court to have a hearing on this proposed move by the mother and to express his opposition.
