Who will get custody?

my ex-husband and I are in the military. I have been in my daughter's life more then he has. She has spent at the most 4-5 mo. with him. Now he wants full custody and is remarried. What can I do? what will the outcome most likely be? I have a lawyer and he keeps telling me not to worry. But we have not gone over anything as to what to expect.

You mentioned that you already have a lawyer and your lawyer is so much more familiar with your case than anyone could ever be by simply looking at your message.... you just don't provide enough details regarding your case. I would go back to your attorney and ask specifically what to expect. In general terms, the court will look at the totality of circumstances and the court will consider what is in the interest of your child. there are many factors to be considered: length of stay with the father and level of confidence that the child has with the father will definitely taken into consideration... but the court will also inquire as to why all of a sudden the father wants custody: is the mother not fit? what are his allegations? Whatever he claims he will need to prove. Again, go back to your attorney and ask for detailed information as to what to expect based on the father's petition for custody.
